Welcome to VideoAncestry. These Terms of Service ("Terms") govern your access to and use of VideoAncestry's website, services, and applications (collectively, the "Service"). Please read these Terms carefully before using our Service.
By accessing or using the Service, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.
You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are a parent or legal guardian permitting a minor between 13 and 18 years of age to use the Service, you explicitly agree to these Terms on behalf of yourself and the minor. You further agree to be fully responsible for the minor's use of the Service, and you hereby bind the minor to all provisions of these Terms, including but not limited to the mandatory arbitration provision and class action waiver in Section 14.
VideoAncestry provides a digital memory preservation platform that enables users to store, organize, and share family photos, videos, documents, and related content. Our Service includes, but is not limited to:
We are constantly evolving the Service. We reserve the right to modify or suspend ancillary features at any time. For any material modification to, or discontinuation of, the core digital storage and preservation Service, we will provide you with a minimum of ninety (90) days' prior notice and a reasonable opportunity to export your User Content.
To access certain features of the Service, you must register for an account. When you register, you agree to:
You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.
You retain all ownership rights to the content you upload to the Service ("User Content"). By uploading User Content, you grant VideoAncestry a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of providing and improving the Service. This license does not grant us any right to use your User Content to train artificial intelligence or machine learning models.
You represent and warrant that:
We do not claim ownership of your User Content. However, we reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or otherwise objectionable.
5.1. One-Time Purchase Fee. Access to the VideoAncestry platform for permanent digital content storage is secured through a one-time purchase fee, as specified at the time of your order. This fee covers the initial ingestion and long-term preservation of your User Content in our geographically distributed storage system.
5.2. Ongoing Maintenance and Account Status. To ensure the long-term integrity, accessibility, and security of your account, a periodic maintenance fee is required. The amount and payment schedule for this fee will be clearly disclosed at the time of purchase and are accessible in your account settings. An account with current maintenance payments is considered in "Active Status."
5.3. Lapsed Maintenance and Content Retrieval. Should your maintenance fee payments lapse, your account will be placed in "Inactive Status." Your User Content will continue to be securely stored but will not be accessible for viewing or sharing. To regain access, you have two options:
5.4. Refunds. We offer a fourteen (14) day, no-questions-asked refund policy. You may request a full refund of your one-time purchase fee within fourteen (14) calendar days of your initial purchase. Maintenance fees, once paid, are non-refundable.
VideoAncestry is committed to long-term preservation of your digital memories. Your User Content is protected by a storage architecture with geographically distributed redundancy, ensuring multiple copies of your data are maintained across separate physical locations. While we employ robust security measures and redundant storage, we cannot guarantee that your data will be preserved indefinitely or that it will never be lost or corrupted.
You are solely responsible for maintaining backup copies of your important data. We strongly recommend that you keep copies of your original files in addition to storing them on our Service.
VideoAncestry is built on a foundational promise: your family memories deserve to last forever. To back that promise, we offer the following tiered Data Preservation Guarantee to all accounts in Active Status (as defined in Section 5).
If VideoAncestry permanently loses your User Content due to our negligence, system failure, or any cause within our reasonable control, and we are unable to recover or restore said content, you are entitled to compensation based on the time elapsed since your initial purchase, provided your account has remained in Active Status. For a complete loss of all User Content, compensation is calculated as follows:
Partial Loss. In the event of a partial loss of User Content (rather than a complete loss of all content), compensation will be prorated based on the proportion of content lost. The proportion will be calculated by comparing the total storage size of the lost files to the total storage size of all User Content in your account at the time of the loss event.

You agree not to use the Service to:
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.
You may terminate your account at any time by contacting us or using the account deletion features in your settings. We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. We will retain your User Content for a minimum of ninety (90) days following termination to allow you to retrieve your data. After such period, we may delete your User Content permanently.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
VideoAncestry does not warrant that the Service will be uninterrupted, timely, secure, or error-free, that the results obtained from the Service will be accurate or reliable, or that any errors in the Service will be corrected.
Cybersecurity Disclaimer: You acknowledge that no data transmission or storage system can be guaranteed to be 100% secure. VideoAncestry cannot and does not guarantee that your User Content will be immune from cyber-attacks, hacking, data breaches, ransomware, or unauthorized access. You assume all risks associated with your use of the Service and the storage of your data.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIDEOANCESTRY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
EXCEPT AS EXPRESSLY PROVIDED IN SECTION 7 (DATA PRESERVATION GUARANTEE), IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE TOTAL FEES PAID BY YOU TO VIDEOANCESTRY.
You agree to defend, indemnify, and hold harmless VideoAncestry and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Washington, without regard to its conflict of law provisions.
Dispute Resolution & Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration within thirty (30) miles of Seattle, Washington before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction.
Class Action Waiver: YOU AND VIDEOANCESTRY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and VideoAncestry agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the changes taking effect. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.
Our Service utilizes Artificial Intelligence (AI) technologies to generate "Talking Photos" and other synthetic media. By using these features, you acknowledge and agree that:
Data Training Pledge: We will not use your personal photos, videos, documents, or other User Content to train or improve our own or any third-party artificial intelligence or machine learning models without your explicit, opt-in consent. Any AI processing of your content is performed solely to deliver the specific features you request (such as Talking Photos) and is not retained for model training purposes.
VideoAncestry is designed for multi-generational preservation. You may designate a "Legacy Contact" or "Beneficiary" in your account settings who will be granted access to your User Content upon verification of your death or incapacitation.
The verification process requires submission of a certified death certificate or court order of incapacitation, along with government-issued identification of the claimant matching the designated Legacy Contact on file. VideoAncestry reserves the right to require additional verification at its sole discretion to protect the account holder's content.
In the absence of a designated beneficiary, access to deceased user accounts will only be granted to verified next-of-kin pursuant to a valid court order. Accounts with no designated Legacy Contact and no court-ordered transfer will be maintained in accordance with the storage terms of the account, but no access will be granted.
This represents the initial version of our Legacy and Inheritance features. We are committed to expanding these tools over time to provide more robust options for multi-generational preservation, including enhanced privacy controls and customizable inheritance workflows.
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and VideoAncestry with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect. The failure of VideoAncestry to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
